The Law Surrounding Lost Wills
If a Will cannot be found then it is presumed that the document has been destroyed. In these situations the burden of responsibility will fall on the benefactors of the Will – they must prove that the Will was not in fact revoked.
If a Will has been lost, destroyed or for some other reason cannot be found people can apply to the court for other documents to be accepted in its place. Documents which can be accepted in place of a Will are:
- Copies of the Will
- Completed drafts
- Evidence of the contents of the Will
Often, these documents can be found with the original writer of the Will or a solicitor.
